General Terms and Conditions of RSN-Switzerland GmbH for Contracts concluded in the RSN-Switzerland Internet Shop

1. Scope of Application

1.1. These General Terms and Conditions ("GTC") shall apply to all deliveries effected and services rendered by RSN-Switzerland GmbH ("RSN-Switzerland") on the basis of orders placed in the Internet Shop. Supplementary or deviating terms and conditions of the customer shall require RSN-Switzerland's explicit written and duly signed acknowledgement in order to be valid.

2. Conclusion of Contract

2.1. All offers of RSN-Switzerland shall be non-binding and are to be understood as an invitation to the customer to submit an offer himself. RSN-Switzerland shall be entitled to accept only parts of such orders.

2.2. Placing of an order will only be possible if all obligatory fields of the online order form (marked with an asterisk) have been completed. Prior to sending the order the customer will receive a summary of the order including prices. The summary can still be corrected by the customer. Receipt of the order by RSN-Switzerland will be acknowledged by an automatically generated e-mail to the e-mail address advised by the customer, which shall, however, not be an acceptance of the order. Messages will only be received by RSN-Switzerland during normal business hours (Monday to Friday from 9 a.m. to 4 p.m. excluding Switzerland public holidays). If orders are received after business hours, they shall be deemed received only at the beginning of business hours on the next working day. The customer shall be obliged to ensure that proper delivery of the goods ordered will be taken.

2.3. The contract will be concluded upon acceptance of the order by RSN-Switzerland, i.e. by mailing of an acknowledgement of order via e-mail to the e-mail address advised by the customer. The acknowledgement of order will contain an order number, which the customer shall state when corresponding with RSN-Switzerland.

3. Description of products

3.1. The descriptions, technical data and product prices may be changed at any time. Valid data are reported online in the order. We can not be held responsible for any typographical or photographic errors.

4. Right of Rescission of Distance Contracts

4.1. In case of a rescission the purchase price shall be reimbursed only if the customer returns the goods delivered at the same time. The goods must be in their original packaging, unused and in a condition in which they can be resold as new. Returns shall be made to RSN-Switzerland GmbH, Reblaubenweg 13, 6047 Kastanienbaum. The cost of returning goods shall be borne by the customer.

4.2. Goods that are impaired by traces of use or otherwise damaged may not be returned. The same applies if accessories are missing upon return of the goods (e.g., original packaging).

5. Prices

5.1. Prices displayed in CHF (Swiss francs) are inclusive of 7.7% VAT. Packaging and shipping: see shipping and delivery information.

6. Delivery and Delivery Period

6.1. Shipping via Swiss Post and DPD shall be at the risk and cost of the customer to the delivery address advised by the customer with the order. If address information provided by the customer is incorrect, incomplete or unclear, any costs resulting there from shall be borne by the customer.

6.2. Stating of delivery dates shall be non-binding, shown only indicative. If RSN-Switzerland, for example, due to non-availability of the goods, is unable to accept an order, RSN-Switzerland shall immediately inform the customer to that effect. The time of delivery is communicated to the customer upon receipt of the order.

6.3. Any and all unforeseeable circumstances or circumstances independent of the parties' intent, such as, e.g., all cases of force majeure and similar events as well as delays in deliveries from sub-suppliers for whatsoever reasons shall extend the delivery period for the duration of the impediment.

7. Terms of Payment

7.1. The customer shall pay the purchase price plus additional costs exclusively by one of the following credit cards: Visa, MasterCard, American Express and PostFinance. The credit card advised will be debited prior to dispatching the order to the delivery address advised by the customer. RSN-Switzerland shall not store the data of the credit card in any form. When transmitting the completed online order form RSN-Switzerland uses the encryption mechanism SSL (Secure Socket Layer) for encrypting the customer data and credit card data to be transmitted. The SSL system can be identified by the fact that the site address (URL) starts with "https" instead of "http" and that a closed lock or key symbol appears in the status bar at the bottom of the screen. For using SSL the customer needs no special software; common web browsers in all recent versions should support the SSL protocol.

7.2. Prepayment You receive the invoice as an e-mail or pdf file with the necessary information for payment, or by mail with a payment slip. The order is effective upon receipt of your payment.

7.3. The goods ordered will only be shipped to the address advised by the customer if the purchase price plus additional costs can be debited to the credit card advised by the customer.

8. Complaint

8.1. Transport damages The customer must immediately notify the carrier of damage or potential gaps, otherwise the delivery shall be deemed accepted.

8.2. Complaints / Returns Basically, the returns are only possible in the case of manufacturing errors or defects in materials. Returned products must be in perfect condition and in their original packaging.

9. Retention of Title

9.1. RSN-Switzerland shall retain title to goods delivered until full payment of the purchase price including all additional costs.

10. Data Protection, Advertising

10.1. The staff of RSN-Switzerland GmbH are subject to the secrecy obligations of the Data Protection Act.

10.2. The customer acknowledges that the customer data stated in the contract may be stored and processed for purposes of book-keeping and customer records. The data shall be used for compliance with statutory provisions, contractual obligations and for carrying out payment transactions. Contracting parties of RSN-Switzerland have been instructed about these data protection provisions and obliged accordingly.

10.3. The customer agrees that the customer data stated in the contract may be used for marketing activities exclusively by RSN-Switzerland for the purpose of further developing the services offered and caring for the customer in an optimal way. The customer may revoke such consent at any time. The customer further consents that RSN-Switzerland may contact him for advertising purposes via e-mail. Such consent may be revoked at any time. Receiving of messages via e-mail may be refused free of charge at any time.

10.4. The data sent using the order form are used exclusively for contact with the customer and are not disclosed or sold to third parties.

11. Place of jurisdiction

The place of jurisdiction is Zug / Switzerland.
