Terms of Sale

These Terms of Sale, along with all documents, policies, and guidelines referenced herein (the “Terms of Sale”) is entered into by and between you on one side (“You,” or “Your”) and RIEDEL Retail Corp., Crystal of America, Inc., and Crystal of New York, Inc. on the other side (collectively, “We,” “Us,” “Our,” or “RIEDEL”), and govern Your purchases of Our products (the “Products”) from Riedel.com, and all subpages and subdomains of Riedel.com (collectively, the “Site”). By ordering Our Products on the Site, You expressly agree to be bound by these Terms of Sale.

Payment Terms

We reserve the right in Our sole discretion to change prices for Products offered for sale on the Site at any time, and to correct pricing errors that may inadvertently occur. Unless otherwise agreed to by Us, payment must be received by Us prior to Our acceptance of an order. Payment must be made by credit card, PayPal, or any other prearranged payment method agreed to by Us. Your order is subject to cancellation by Us, in Our sole discretion. We are not responsible for pricing, typographical or other errors in any offer and We reserve the right to either contact You for instructions before shipping or cancel any orders arising from such errors. We generally do not charge Your payment method until after Your order has entered the shipping process.

Shipping; Taxes; Title; Risk of Loss

Shipping, handling, and tax are additional unless otherwise expressly indicated at the time of sale. All items purchased from Us are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon Our delivery to the carrier. You must notify Us within 3 days of the date of Your invoice or acknowledgement if You believe any part of Your purchase is missing, wrong, or damaged.

We endeavor to ship your purchase within 3 business days of receiving your order. The time it takes to receive Your order depends on the shipping method You choose during checkout, and the time of day You place Your order. We offer the following delivery estimates:

  • Ground delivery: arrives within 5-7 Business Days from shipping confirmation; and
  • Express 2nd day delivery: arrives in 2 Business Days from shipping confirmation.

The aforementioned delivery estimates are mere estimates subject to the acceptance and approval of Your order. Additionally, deliveries can take longer in certain remote areas. As such, the delivery estimates shall not bind RIEDEL, nor shall they serve as a basis for imposing liability upon RIEDEL for any shipment that fails to meet these estimated delivery dates. “Business Days” are defined as Monday to Friday 9am to 5pm, excluding federally recognized United States holidays.

Orders $75 or more will be delivered free. No promo code needed. Valid on standard U.S. ground shipping to U.S. delivery addresses in the 48 continental states only. We do not offer Saturday shipping. Not valid for Alaska, Hawaii, U.S. territories, P.O. Boxes, and APO/FPO addresses.

We will send You several emails during the order process to keep You informed about the different stages of Your order. In addition, Your MYRIEDEL account will allow you to follow your order status. Order Cancellations/Modifications

If You are looking to cancel an order that was recently placed, please immediately contact our customer service on 1-888-4-RIEDEL (1-888-474-3335) or via e-mail to webshopusa@riedel.com, and one of Our Support Reps will be able to help out. Once an order has been placed, there is a very short timeframe in which We can cancel the order, so We cannot guarantee that We will be able to cancel Your order. All orders typically ship out within 1- 3 Business Days. Should cancellation not be possible, You can refuse delivery of the package, and a refund will be issued minus shipping costs upon return receipt of the package. 

For security reasons, we unfortunately cannot make address changes once an order has been placed. UPS will make three attempts to deliver Your package to the provided address, and after the third attempt Your will be able to arrange for pickup from the nearest UPS facility. Otherwise, the shipment will be returned to Our warehouse and a refund will be processed for the Products.

Return Policy

For Products ordered on the Site, RIEDEL will provide You a refund as long as the following return procedure is followed:

  • The Products must be returned in new and unused condition and inside the original RIEDEL box;
  • The Products must be returned and received by RIEDEL within 30 days of the date of purchase;
  • The reason(s) for the return must be documented on the packing slip and inserted in the shipping box;
  • The Product return label must be completed as instructed and affixed on the shipping box.
  • All packages must be returned prepaid.

You should expect to receive your refund within four weeks of receipt; however, in most cases You will receive a refund more quickly. This time period includes the transit time for Us to receive your return (5 to 10 Business Days), the time it takes Us to process Your return once We receive it (3 to 5 Business Days), and the time it takes Your bank to process Our refund request (5 to 10 Business Days). After successful completion of the refund You will find a credit on Your credit card statement.

Please note that this policy applies only to items purchased on the Site. RIEDEL will not accept returns for Products purchased on third-party websites or any retail store.

If You would like to exchange a Product You previously purchased from the Site for a new Product, please return the originally purchased Product in accordance with the above-listed steps and place another order for the new Product You wish to purchase. You will be refunded Your original purchase price once we receive the original Product. You do not have to wait for us to receive the original Product before placing the order for the new Product.

CHANGED OR DISCONTINUED PRODUCT

Our policy is one of ongoing update and revision. We may revise and discontinue Products at any time without notice to You and this may affect information saved in Your online shopping cart.

RIEDEL LIMITED WARRANTY

IMPORTANT: BY USING THE PRODUCTS YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LIMITED WARRANTY. DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ ALL TERMS OF THIS LIMITED WARRANTY. IF YOU DO NOT AGREE TO THE TERMS OF THIS LIMITED WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD STATED IN THE RETURN POLICY (FOUND AT www.riedel.com/en-us/shopping/withdrawal).

We warrant Your Product against defects in materials and workmanship when purchased directly from RIEDEL or a RIEDEL authorized reseller. This warranty is extended only to the original end-user purchaser or the person receiving the Product as a gift and shall not be extended to any other person or transferee. This warranty is valid for a period of one (1) year from the date of original retail purchase.

THIS WARRANTY DOES NOT APPLY TO PRODUCTS THAT ARE PURCHASED FROM SELLERS OTHER THAN RIEDEL OR A RIEDEL AUTHORIZED RESELLER.

Due to technical reasons and because of the materials used in the course of the production of glass Products, deviations may occur between Products from the same series, in particular with respect to size, weight, ovality, or the vertical axis according to the relevant technical drawings, which cannot be controlled by RIEDEL. Handmade Products or handmade Product parts may be subject to sample and size deviations. All such deviations between Products, in particular compared to earlier deliveries of the same Product, therefore do not constitute a defect and do not entitle to warranty claims.

For warranty service on a covered warranty defect during the warranty period, contact RIEDEL at webshopusa@riedel.com. Prior to providing warranty service, RIEDEL may require You to provide proof of purchase details, including but not limited to a receipt or sales invoice. In the event of a justified complaint about a Product deviation beyond those uncontrollable deviations as detailed in the immediately preceding paragraph, RIEDEL shall be entitled to remedy the defect, in particular by replacing the allegedly defective Product. If RIEDEL, for whatever reason, chooses not to provide You with a replacement Product, You will be entitled to demand a price reduction or, if the defect is substantial, a refund for Your purchase.

This limited warranty gives You specific rights that are in addition to other rights You may have under applicable laws, including Your rights against the person who sold the Product to You. TO THE EXTENT PERMITTED BY LAW, HOWEVER, THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY RIEDEL. RIEDEL DISCLAIMS ALL OTHER WARRANTIES WHETHER EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT), AND RIEDEL’S LIABILITY SHALL BE LIMITED TO THE ORIGINAL PURCHASE PRICE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

NOT FOR RESALE OR EXPORT

You agree and represent that Your are buying for Your own internal use only, and not for resale or export. Products may not be sold, leased or transferred to restricted countries, restricted end users or for restricted end uses.

GOVERNING LAW

The laws of the State of New Jersey, without regard to principles of conflict of laws, will govern these Terms of Sale and any dispute of any sort that might arise between You and RIEDEL. Any dispute arising between You and RIEDEL that is not resolved pursuant to the Dispute Resolution section below shall be resolved exclusively by the state and/or federal courts of the state of New Jersey.

DISPUTE RESOLUTION

Due to the high cost of litigation, in time and money, both Your and RIEDEL agree to the following dispute resolution:

In the event of any claim, action, dispute or controversy arising from, or related to these Terms of Sale or any transaction conducted on Our Site, the party asserting the dispute will first try to settle such dispute in good faith by providing written notice to the other party. The notice must be sent by registered mail, must describe the issues of the dispute, and must include substantiating documentation related to the dispute. The parties agree to 30 days from receipt of dispute to respond or settle dispute. For disputes against RIEDEL, notice shall be mailed to:

To the extent not resolved through the process described above, the parties agree to arbitrate any claim, dispute, or controversy, including all statutory claims and any state or federal claims, that may arise out of or relate to these Terms of Sale, or any transaction conducted on Our Site. All arbitration hearings shall take place in the state of New Jersey. BY AGREEING TO ARBITRATION, THE PARTIES UNDERSTAND AND AGREE THAT THEY ARE WAIVING THEIR RIGHTS TO MAINTAIN OTHER AVAILABLE RESOLUTION PROCESSES, SUCH AS A COURT ACTION OR AN ADMINISTRATIVE PROCEEDING, TO SETTLE THEIR DISPUTES.

IN RELATION TO THE ABOVE DESCRIBED CLAIMS, DISPUTES, AND CONTROVERSIES, THE PARTIES ALSO AGREE TO GIVE UP ANY RIGHT THEY MAY HAVE (1) TO BRING A CLASS OR COLLECTIVE ACTION LAWSUIT OR CLASS OR COLLECTIVE ACTION ARBITRATION, OR PARTICIPATE IN EITHER AS A CLAIMANT, OR (2) TO CONSOLIDATE THEIR ARBITRATION WITH THE ARBITRATION OF OTHERS.
